Welcome to Base 2 Notes. By accessing or using our website and application at base-2-notes.com ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

• You must provide a valid email address and create a password to register
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Your Content

You own your content. All notes, drawings, mind maps, kanban boards, calendar events, and other content you create using the Service remain your intellectual property. We do not claim any ownership rights over your content.

By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing and improving the Service. This license ends when you delete your content or your account.

4. Encryption & Vault

The encryption vault uses client-side encryption. Your vault password is never transmitted to or stored on our servers. If you lose your vault password, we cannot recover your encrypted notes. You are solely responsible for remembering your vault password and maintaining access to your encrypted content.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Store or distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's infrastructure
• Use automated tools to scrape, crawl, or overload the Service
• Store or distribute content that infringes on the intellectual property rights of others
• Use the Service for any illegal, harmful, or abusive purpose

6. Third-Party Integrations

The Service may integrate with third-party services (e.g., Spotify). Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

7. Service Availability

The Service is provided on an "as is" and "as available" basis. We make no guarantees regarding:

• Uninterrupted or error-free operation
• Data availability or backup (we recommend exporting important content regularly)
• Compatibility with all devices or browsers

We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice when possible.

8. Data Export & Portability

You may export your notes at any time in HTML, Markdown, PDF, or plain text format using the built-in export feature. We encourage you to maintain your own backups of important content.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We shall not be liable for any loss of data, including data loss caused by encryption vault password loss, service interruptions, or technical failures
• Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim (if any)

10. Indemnification

You agree to indemnify and hold harmless Base 2 Notes, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your right to use the Service ceases immediately
• We may retain certain data as required by law or for legitimate business purposes

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify active users.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal proceedings.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
